Cohen’s Corner – Straight talk from the Doctor: Who owns the X-Rays

Hello again from the corner!  Today we are going to talk about a question that I must have answered over a thousand times in my thirty plus years in dentistry:  Who owns the records and why?

Sometimes when the call comes in to have records, including X-rays, sent out of the office these calls become the most frustrating for both the office staff and the patient.  Everybody is under the false assumption that because they are “my records” and “I paid for them” that “I want them, so give them to me”.  Like most disputes in a democratic system when an argument can’t be resolved we turn to the courts for a just and equitable solution.  The courts have ruled on who owns the records and the answer is as follows:

"X-rays taken are the doctor’s property, retained on the same theory as the patient’s medical history record or other diagnosis or treatment."

Under legal test, the court ruled:

“the x-ray plate becomes the veritable foundation stone of the doctor’s diagnosis and report and it is essential that he retain it as a permanent record in support of his diagnosis, for should it be destroyed by unskillful handling or loss, the doctor would have no means to justify the correctness of his diagnosis or findings in the event of challenge to his Professional opinions.”

“Paraphrased from law of the hospital, etc., Hay and Goreschell.” The Arizona revised statutes related to dental records Is as follows:

Title 20. Chapter 6, Article 18.R-20-6-1810

a. Dental records are the property of the provider and shall not be removed from the provider’s possession, except:

  1. With the patient’s permission, including for routing records to a dental or medical practitioner for consultation or evaluation; or

  2. When subpoenaed by a court or bode.

Savon Gift Certificates - A great holiday gift

This is the time of the year when there is a big up-surge in the amount of candy eaten.  This means more sugar and maybe more toothaches!!  Remember:  It is important to go at least once a year, (every six months would be better) for cleaning and checkups.  We need to maintain our teeth to keep them in good condition.

During the holidays, what better gift to give to someone who may need dental work than a Savon Dental gift card.  Show a friend or family member that you really care about their oral health and their finances.  As a way of saying “Thank You” for the referral we will add two free months to your account.

Schools Back in Session

This is the time of year that kids dread and parents look forward to.  SCHOOL IS BACK IN SESSION!!  Please make sure that you are aware of the children walking or riding bikes to and from school and REMEMBER:  THE SPEED LIMIT IN A SCHOOL ZONE IS 15 MPH

Now is also a good time to check out our Student Plan.  This plan is great for the student in college.  The cost is very reasonable and the benefits are the same as the Savon Basic Plan.

Savon Gift Certificates - A great holiday gift

As the year seems to fly by some of us forget about our dental needs.  Most live by the old saying if it isn't broke don't fix it.  In fact, in the long run that could end up costing you more.  It is important to go at least once a year, (every six months would be better) for cleaning and checkups.  It is similar on how we do the oil change in our cars just to keep the running smooth.  We need to maintain our teeth to keep them in good condition.

With the holidays approaching what better gift to give to someone who may need dental work than a Savon Dental gift card.  Purchase one for a friend or family member and as a way of saying “Thank You” for the referral we will add two free months to your account.
